Admittance
If not stated otherwise, all partners are admitted as lawyers (Rechtsanwälte) in the Federal Republic of Germany and belong to the Chamber of Advocates of Munich and Frankfurt/Main, as the case may be.
Professional Codes of Practice
The relevant professional regulations can be found on www.brak.de under the section “Berufsrecht” (Professional Regulations). The pertaining regulations include:
- the Federal Lawyers' Act (Bundesrechtsanwaltsordnung – BRAO),
- the Rules of Professional Practice (Berufsordnung - BORA),
- the regulations relating to accredited specialist lawyers (Fachanwaltsordnung),
- the Lawyers' Fees Act (Rechtsanwaltsvergütungsgesetz – RVG), and
- the Code of Conduct for European Lawyers (Berufsregeln der Rechtsanwälte der Eurpäischen Gemeinschaft – CCBE).
Professional Indemnity Insurance
Professional indemnity insurance is held with Allianz Versicherungs-AG in 10900 Berlin. The geographical scope of the insurance covers activities in the Member States of the European Union, satisfying the minimum requirements under Art. 51 BRAO.
Avoiding Conflicts of Interest
Pursuant to Art. 43a (4) BRAO German lawyers are prohibited from representing conflicting interests. Prior to the acceptance of an engagement, a conflict of interests check will therefore be carried out.
Out-of-Court Dispute Settlement
On request disputes between lawyers and their clients can be settled out of court by the regional Chamber of Lawyers (Rechtsanwaltskammer) pursuant to Art. 73 (2) no. 3 in connection with Art. 73 (5) BRAO or by the Federal Conciliation Body (Schlichtungsstelle der Rechtsanwaltschaft) of the Federal Chamber of Lawyers (Art. 191f BRAO), which can be found on the internet on the homepage of the Federal Chamber of Lawyers (Bundesrechtsanwaltskammer) (www.brak.de or by e-mail: schlichtungsstelle@brak.de).
Online Dispute Resolution platform and Consumer Conciliation Procedures (Art. 14 para 1 of the ODR-Ordinance and § 36 German Consumer Protection Act)
The European Commission provides a platform for out-of-court dispute resolution, which can be found at http://ec.europa.eu/consumers/odr/. In Germany, the competent consumer conciliation board for disputes over proprietary interests resulting from a client relationship is the Lawyers' Meditation Board (Schlichtungsstelle der Rechtsanwaltschaft), Neue Grünstraße 17, 10179 Berlin, http://schlichtungsstelle-der-rechtsanwaltschaft.de.
